Testing positive on a Department of Transportation (DOT) drug or alcohol test can be a difficult experience. It’s normal to feel embarrassed, worried, or afraid of the job-related consequences.
However, this situation has a solution. With proper guidance and by completing each requirement of the process established by the DOT, you can safely return to work as a driver in full compliance with current regulations.
These are the steps you must follow in order to drive again:
1. Stop driving immediately
If you test positive for a DOT drug test, you are prohibited from performing any safety-sensitive functions, such as driving a commercial motor vehicle (CMV). You must stop driving as soon as you receive the test result and notify your employer.
2. Meet with a substance abuse professional (SAP)
A SAP is a qualified person who can evaluate your situation and recommend a treatment plan for your substance abuse problem. You must meet with a SAP within five days of receiving the test result and follow their recommendations.
3. Complete the treatment plan
Depending on your situation, the SAP may recommend that you undergo counseling, education, rehabilitation, or other interventions to address your substance abuse problem. You must complete the treatment plan and provide proof of completion to the SAP.
4. Take a return-to-duty test
Before you can resume driving, you must take another DOT drug test and obtain a negative result. The SAP will determine when you are ready to take the test and will refer you to a testing site. You must pay for the test yourself.
5. Follow-up testing and aftercare
After you pass the return-to-duty test, you must undergo follow-up testing for at least 12 months. The SAP will specify the frequency and duration of the testing, which may be up to six times per year. You must also comply with any aftercare recommendations from the SAP, such as continuing counseling or attending support groups.
Consequences of Not Complying with the DOT Process
If you test positive again or fail to complete any of the required steps, you may face serious consequences, such as permanently losing your license or facing legal action.
Remember that all of these steps must be completed personally by the driver and recorded in their DOT Clearinghouse account.
